Part A — Standing disclaimers

These apply continuously and are also surfaced in context inside the Platform.

A-1. General information / no professional advice. Homegoing360 provides general educational information and organizational tools. It is not a law firm, funeral home, insurer, financial advisor, tax advisor, medical provider, or grief-counseling practice, and provides no legal, financial, tax, insurance, medical, or professional advice. Information — including AI output — is not a substitute for advice from a qualified, licensed professional in your jurisdiction.

A-2. Legal information disclaimer. Information about probate, estates, executors and personal representatives, forms, deadlines, and procedures is general legal information, not legal advice, and does not create an attorney-client relationship. Laws and procedures vary by state and county and change over time. Consult a licensed attorney for advice about your situation. Contested, insolvent, or complex estates require an attorney.

A-3. Probate and court information disclaimer. The Probate Assistant and related content describe general court procedures and possible paths based on limited inputs. They do not determine your legal obligations, guarantee any outcome, or replace the county probate court’s instructions or an attorney’s judgment. Verify thresholds, forms, and deadlines with the court or an attorney.

A-4. Financial and tax disclaimer. Any financial, benefits, budgeting, or tax information is general and educational. Homegoing360 is not a financial advisor, investment adviser, or tax professional. Consult a qualified professional before making financial or tax decisions.

A-5. Insurance disclaimer. Any insurance-related information (including life-insurance claim guidance and funding tools) is general and educational. Homegoing360 is not an insurance company, producer, agent, or adjuster, and does not sell, place, or adjust insurance. Coverage, eligibility, and claims are determined solely by the insurer and applicable law. Consult a licensed insurance professional.

A-6. Medical and mental-health disclaimer. Homegoing360 does not provide medical or mental-health care. Content is not medical advice. In an emergency, call 911. For emotional support, consider the 988 Suicide & Crisis Lifeline or a licensed professional.

A-7. Marketplace disclaimer. Concierges, providers, designers, and partners are independent third parties, not employees or agents of Homegoing360. We do not control them or guarantee their services, products, licensing, insurance, or outcomes. Any contract for their services is between you and them. See the Provider Directory & Paid Placement Disclosure.

A-8. “As is” notice. The Platform and all content and services are provided “as is,” subject to the disclaimers and limitations of liability in the Terms of Service.

Part B — The acknowledgments we ask for, and the ones we record

B-1. Terms, Privacy, and Acceptable Use — at registration ✅ recorded

Shown as a required checkbox when you create an account. Recorded with the exact sentence, its version, the date and time, and your account identifier. Re-acceptance after a material update is recorded alongside the original, not in place of it.

This is the record the Arbitration Agreement’s 30-day opt-out window is measured from.

B-2. Text-message consent — when you add a mobile number ✅ recorded

A separate, express opt-in, default off, and never a condition of purchase. Recorded with the exact sentence, its version, and the date and time. Opt-outs — whether by replying STOP or by switching reminders off in the app — are recorded too.

B-3. Publishing an obituary that names living people — before publication ✅ enforced

Before a “survived by” list can appear on a public memorial page, the Platform reads the names back to you and requires an explicit acknowledgement that you have the right to publish them. The working draft is never published by anything else, and this is the only path to publication.

B-4. Sealing a recording — before it is sealed ✅ enforced

Sealing is a separate, deliberate step, and the Platform tells you first that a sealed recording cannot be edited or deleted by anyone, including us. Nothing is sealed by default.

B-5. Encryption scope — before you rely on it ✅ enforced

Before you use the on-device lock, the Platform tells you three things: which fields it covers, which it does not, and that a lost passphrase cannot be recovered by anyone. Choosing to encrypt every field rather than account numbers alone requires reading what that costs you.

These appear where they are relevant, as notices rather than as checkboxes:

  • AI — the short-form notice in the AI Usage Disclosure appears at the point of AI interaction.
  • Marketplace and provider independence — A-7, shown when you view providers.
  • Payment authorization — presented at checkout, as described in the Payment Terms & Authorization. The transaction record is retained; a separate acknowledgment is not.
  • Print and proof approval — you approve a preview before a personalized item goes into production, per order.
  • Photo and video rights — the representations in the Memorial, Photo, Obituary & Tribute Terms apply when you upload media.

Not currently offered

  • Marketing email consent. We do not send marketing email, so there is nothing to opt into. Everything we send is a service message about something you are doing.
