Communications Consent (Email / SMS / TCPA / CAN-SPAM)

1. Types of communications

1.1 Service and transactional (email and in-app). Necessary messages to operate the Platform: account, security, billing, order and print status, family invitations, the weekly family digest, and legal notices. These are sent while your account is active and are not marketing.

1.2 Marketing email. We do not send marketing email. There is no promotional list, no newsletter, and nothing to opt into. If that ever changes, it will be opt-in, default off, and this document will say so before the first one is sent.

1.3 SMS / text (optional). If you provide a mobile number and opt in, we may send text reminders as described in Section 3.

2. Email consent and CAN-SPAM

By providing your email and using the Platform, you consent to receive service and transactional emails. Every message identifies Homegoing360 as the sender and includes our physical postal address.

The weekly family digest carries an unsubscribe link that works without signing in, and the same switch silences text reminders. That link can only ever turn contact off — there is no re-subscribe by link anywhere in the Platform, because a link in an email is not consent. Turning something back on requires signing in.

Unsubscribing from the digest does not stop the messages required to operate your account, such as a security notice or a billing receipt.

3. SMS program terms (TCPA / CTIA)

These terms govern text messages and reflect an express opt-in.

3.1 Consent. By checking the SMS box and providing your mobile number, you agree to receive reminder text messages from Homegoing360 at that number about your estate’s tasks and deadlines, including messages sent using an automated system. Consent is not a condition of purchase, and it is default off.

The exact sentence you agree to is:

I agree to receive text-message reminders from Homegoing360 about this estate’s tasks and deadlines. Message & data rates may apply. Reply STOP to opt out at any time.

3.2 Message frequency. Frequency varies with your estate’s tasks and approaching deadlines — occasional reminders, not a fixed number.

3.3 Rates. Message and data rates may apply, per your mobile plan.

3.4 Opt out. Reply STOP to any message to unsubscribe, or turn text reminders off in the app. Either one stops them. Reply HELP for help, or contact care@homegoing360.com.

3.5 Carriers. Carriers are not liable for delayed or undelivered messages. Availability varies by carrier.

3.6 No sharing for third-party marketing. We do not share or sell your mobile number or your SMS consent to third parties for their own marketing. Consent is specific to Homegoing360, and the number is shared only with Twilio, the provider that delivers the messages.

3.7 Changes. If we materially change the SMS program, we will obtain renewed consent.

4. Withdrawing consent and preferences

Manage communications at any time in your account settings: turn off the weekly digest, turn off text reminders, or reply STOP to a text. Required service messages continue while your account is active.

5. What we record

For text messages, we record: the exact consent sentence, its version, the date and time, and the mobile number. Opt-outs are recorded the same way, whether they arrive as a STOP reply or as a switch turned off in the app. These records are kept for the period in the Data Retention Policy, and they exist to demonstrate that a message we sent was one you asked for.

We do not keep an equivalent record for email, because service email is required to operate the account rather than consented to separately — and because we send no marketing email to consent to.
